After his trial on an obstruction of justice charge ended in a hung jury, an additional charge of refusing to leave property after notice has been filed against 40-year old Reed Bender of Mitchell. The additional charge, along with the obstruction charge, stems from an incident which occurred at a Mitchell School Board meeting in September of last year. The Mitchell School District had a mask mandate in place. Bender attended the meeting without a face covering, and when he refused to comply with the mandate, authorities were called. A brief altercation took place when officers attempted to physically remove Bender from the room. The obstruction charge was later filed, and the new charge was filed this week. Davison County will retry Bender on the original charge with a new trial scheduled to begin January 19th.
