A new jury trial date has been set for a Mitchell man charged with obstruction after he refused to leave a Mitchell School Board meeting last September after not complying with the school district’s mask mandate. Reed Bender is scheduled to go to trial October 18th through October 20th. During a motions hearing on Thursday, Judge Donna Bucher denied a defense request for sanctions to be imposed on the prosecution. Defense Attorney R Shawn Tornow says discovery was not provided in a timely manner by Davison County State’s Attorney Jim Miskimins. Judge Bucher also denied a defense request for the case to be dismissed after Tornow said Bender’s right to a speedy trial, within 180 days, was violated. Bender faces up to a year in jail if found guilty of the misdemeanor charge.
