A prison sentence reduction was denied for a Mitchell man who is serving a seven-year prison sentence for driving a vehicle from which multiple shots were fired, hitting a house and two vehicles in a Mitchell neighborhood in 2021.

27-year old Isaac Chytka, who is in a minimum-security unit, will be up for parole in May of next year. He sought early release due to good behavior and because he cannot seek work release, earn discharge credits, or participate in programs until March.

Assistant State’s Attorney Katie Mallery argued that as Chytka approaches his parole date, pre-release programs will be made available to him and that the court has already shown him leeway in suspending more than half of his prison sentence. She also said Chytka’s crime was a calculated crime, and he is lucky no one was killed by the 13 gunshots fired in the incident.

Chytka was sentenced in 2022 to 15 years in prison with 8 years suspended after pleading guilty to one count of aiding and abetting aggravated assault.

In court on Tuesday, Chytka apologized to one of the victims, saying he was grateful that no one was hurt.
