MITCHELL, SD (Mitchell Now) — A Rosebud man has been sentenced to federal prison after being convicted of failing to register as a sex offender, U.S. Attorney Ron Parsons announced.
U.S. District Judge Eric C. Schulte sentenced Lavern David Luxon Jr., 34, on Dec. 2, 2025, to one year and one day in federal prison, followed by five years of supervised release. Luxon was also ordered to pay a $100 special assessment to the Federal Crime Victims Fund.
Luxon was indicted by a federal grand jury in July 2025 and pleaded guilty on Sept. 3, 2025. According to court documents, Luxon was convicted of Sexual Abuse of a Minor in 2017 and is required to register as a sex offender, updating his information within three days of any move, employment change or change in student status.
Officials said Luxon began a period of supervised release in June 2023 while living in Rapid City and initially complied with registration requirements. In September 2024, however, he moved from his registered address and absconded from supervision. His whereabouts were unknown until authorities located and arrested him in Rosebud on July 2, 2025.
The case was prosecuted as part of Project Safe Childhood, a nationwide Department of Justice initiative focused on combating child sexual exploitation. More information on the program is available at the DOJ’s official website: https://www.justice.gov/psc.
The investigation was conducted by the U.S. Marshals Service, and the case was prosecuted by Supervisory Assistant U.S. Attorney Kirk Albertson. Luxon was remanded to the Marshals Service following sentencing.
