PIERRE, S.D. (MITCHELLNOW) The South Dakota Supreme Court ruled that Summit Carbon Solutions violated private landowner rights and trespassed with their invasive surveys for their proposed carbon capture pipeline that is slated to run from Iowa through South Dakota and into North Dakota.
In addition, the South Dakota Supreme Court ruled that Summit Carbon Solutions is not a “common carrier” which means that if a pipeline is to go through South Dakota, Summit will not be able to invoke eminent domain in laying the pipeline. The Court also ruled that carbon is not a commodity.
This ruling is a blow to Summit’s plans to run a pipeline across South Dakota, especially since Iowa’s approval was contingent on both South Dakota and North Dakota also agreeing to host the pipeline.
