An obstruction of justice charge against 40-year old Reed Bender of Mitchell was dismissed without prejudice on Thursday in Davison County Court.  Bender’s October trial on the charge ended in a hung jury.  He now faces a charge of entering or refusing to leave property after notice, which is a Class 2 misdemeanor.  Bender refused to wear a mask to a Mitchell School Board meeting in September 2020 and refused to leave when asked to do so.  When officers were called, a brief physical altercation followed with Bender eventually leaving the premises.  Bender has pleaded not guilty to the amended complaint.  A review hearing was set for January 6th.
